Please read these Terms of Service carefully before using the VoiceiQ platform and associated services operated by Blue Lobster Technologies Private Limited ("VoiceiQ", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Service Description

VoiceiQ provides AI-powered voice agent solutions that enable businesses to automate inbound and outbound voice communications. Our platform deploys human-like AI agents capable of handling customer inquiries, payment collections, claims processing, appointment scheduling, and customer support across multiple Indian languages.

2. Account Registration

To access our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old and have the authority to bind your organization to these Terms.

3. Subscriptions & Billing

Our Services are offered on a subscription basis with usage-based pricing. Billing cycles are determined by your selected plan. Subscriptions auto-renew unless cancelled before the renewal date. You authorize us to charge your designated payment method for all fees incurred.

We reserve the right to modify pricing with 30 days' prior notice. Continued use after price changes constitutes acceptance of new rates.

4. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable laws or regulations, including telemarketing and privacy laws
  • Harass, abuse, or harm any person through automated voice communications
  • Transmit fraudulent, deceptive, or misleading content
  • Impersonate any person or entity without proper authorization
  • Interfere with or disrupt the integrity of our Services
  • Attempt to gain unauthorized access to our systems or networks

5. Voice Recordings & Data

Our platform records voice conversations for quality assurance, compliance, and service improvement. You are responsible for obtaining all necessary consents from end-users before initiating calls through our platform. You retain ownership of your data while granting us a limited license to process it for service delivery.

We may use anonymized and aggregated data to improve our AI models and Services.

6. Intellectual Property

The VoiceiQ platform, including all AI models, algorithms, software, designs, and documentation, remains our exclusive property. You receive a limited, non-exclusive, non-transferable license to use our Services during your subscription period.

7. Service Level & Availability

We strive to maintain 99.9% uptime for our Services. However, we do not guarantee uninterrupted access and are not liable for downtime due to maintenance, third-party service failures, or circumstances beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, VoiceiQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold VoiceiQ harmless from any claims, damages, or expenses arising from your use of our Services, violation of these Terms, or infringement of any third-party rights.

10. Termination

Either party may terminate this agreement with 30 days' written notice. We may suspend or terminate your access immediately for violation of these Terms. Upon termination, your right to use the Services ceases, and we may delete your data after a retention period specified in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.

12. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
